Ice cream man arrested on sex charges

A local ice cream truck driver who has been charged with felonious prostitution is in jail awaiting an Aug. 10 trial following a breach of his bail conditions and his second arraignment in four days.

A resident of 43 Front St. in Pembroke, 34-year-old Gary Brown was arrested by Allenstown police on Friday, May 20, after he allegedly told a 14-year-old boy he would perform sexual acts for anyone wanting $50.

One day later, after reaching his $25,000 bail - and under the restriction that he have no contact with anyone under age 18. Brown was witnessed with three children approximately 12 to 13 years old in the parking lot of the Loudon Road Wal-Mart in Concord.

Brown was spotted standing near his gray Mercedes Benz which had a temporary license plate that read, "ICE CREM." A witness who approached Brown on the scene told Concord police officer Joseph L. Wright that Brown seemed uncomfortable with being approached, and sped out of the parking lot after nearly hitting another car.

Allenstown Police Chief James McGonigle said Brown was arrested later that night, at his parents' home in Bow.

If convicted, McGonigle added, Brown faces three-and-a-half to seven years in prison.

It would not be Brown's first time behind bars. McGonigle said Brown was guilty of stabbing a female acquaintance at the University of New Hampshire, Durham, nine times.

McGonigle said his department has notified the Secretary of State of Brown's case, and suggested that they revoke his peddlers and hawkers license, which he said costs $50, and doesn't require a background check.

Brown, who has sold ice cream in Allenstown, Pembroke and Hooksett, now waits in the Merrimack County Jail with bail set at $150,000.
